Being Considered

Federal Regulations

Unregulated

Kratom is not federally regulated in the U.S., leaving its legality up to individual states. However, the Food and Drug Administration (FDA) has issued warnings about its potential risks, and there have been attempts of a federal ban in the past.

Importing

Since 2012, FDA Import Alert 54-15, permits detention of kratom-containing dietary supplements and bulk ingredients at U.S. borders due to safety concerns and its classification as an unapproved New Dietary Ingredient (NDI). However, this classification is incorrect, as kratom has been used in the U.S. since the Vietnam War and sales receipts from 1988 prove it was marketed before 1994, qualifying it as an Old Dietary Ingredient (ODI).
